ARTICLE  III: MEMBERS

 

Section 1. Application for Membership:  An application will be given to a candidate after Regular member who is in good standing brings candidate before the executive board. The application shall be returned to the secretary as soon as possible. At the next meeting after the application is returned the candidate shall be informed of his status as a prospective member. If the application is not returned within thirty days, the application will become invalid.

Section 2. Qualifications: Any person dedicated to the purposes of the SHMCNY, at least twenty-one (21) years of age, and who holds a valid Motorcycle [endorsed] license/permit shall be eligible for membership upon acceptance of his or her application by the Executive Board, compliance with these bylaws, and payment of such dues and fees as may from time to time be fixed by the Executive Board. Applicant may not hold membership in any other Motorcycle Club.

Section 3.  Election to Membership: The E-board shall vote a prospective member to be nominated for membership status.  An affirmative majority vote of the E-board is required for nomination to membership. After a prospective member has been successfully nominated, an affirmative vote of at least three-fourths of all regular members is required for election to membership. Acceptance to membership requires:

1)   Satisfactory completion of established prospect or probationary period, and

2)   Sponsorship from any existing member, sponsor must be a member with twelve (12) or more months membership in SHMCNY.

3.1) However, any such acceptance of any applicant may be denied by a vote of a majority of the Executive Board, or upon three-quarters (3/4) vote of all members in good-standing, present at general monthly meeting. Acceptance of application for membership shall not be unreasonably withheld, and shall be granted, except in the case of failure to meet qualifications herein or in conflict with membership policies set by the Executive Board.

 

Section 4. Voting: Each member in good-standing shall be entitled to vote, accept as maybe restricted herein, at an election of Officers, and on issues submitted to the members by the Executive Board, such issues may be submitted to the membership at general monthly meeting.

 

Section 5.  Withdrawal: Any member may resign their membership by presenting a letter of resignation (hard copy or email) and relinquishing their Colors to the President or Vice-President.  To voluntarily withdraw as a member in-good- standing the member must:

1) Return all SHMCNY property to include, but not limited to:

a. All membership patches (colors);  and b.  All membership cards.

2) Have no outstanding debt owed to SHMCNY or any other organization as a result of your affiliation with SHMCNY.

3) Not be involved in or being considered for disciplinary actions, to include probation, at the time of the request for membership withdrawal.

 

Section 6. Termination:  Cause for termination of membership shall include, but not be limited to: fighting, illegal acts, or any conduct deemed unacceptable as determined the Executive Board.  Only the Executive Board may send a motion to the general membership for termination of membership of any member by a vote of three-fourths of the Executive Board.  All members absent at the time the motion is made shall be notified of the motion to terminate and afforded the opportunity to vote on the motion. A member's membership may be terminated by three-fourths vote of all members and may not be taken by secret ballot. The vote on termination membership shall be counted by the highest ranking member of the executive board in attendance. An appeal for the reversal of an involuntary withdrawal may be submitted as defined herein. If you are requested to involuntarily withdraw your membership you agree to:

1) Return all SHMCNY property to include, but not limited to:

a. All membership patches (colors); and

b.  All membership cards.

2) Pay any outstanding debt owed to SHMCNY or any other organization as a result of your affiliation with SHMCNY.

 

Section 6a.  If you choose to exercise your option to appeal; prior to or at the same time as you file your appeal you must provide proof to the Sgt-At-Arms that you have:

1) Returned all SHMCNY property to include, but not limited to:

a. All membership patches (colors)

b. All membership cards.

2) Pay any outstanding debt owed to SHMCNY or any other organization as a result of your affiliation with SHMCNY.

Section 7. Membership Year:  The membership year for the SHMCNY shall be from the first day of January to the last day of December of each year.

 

Section 8.  Types of membership, rights and privileges:  The various types of memberships and the rights and privileges that pertain to such memberships are as follows:

1) Member. Member is anyone who has fulfilled the requirements of a Prospect. Members shall be eligible for privileges and benefits of SHMCNY.

A Member in good-standing.

(a)  Must possess/own maintain a functioning safe motorcycle or approved motorized vehicle

(b)  Has no outstanding debt with SHMCNY, including but not limited to dues

(c) Not be involved in or being considered for disciplinary actions, to include probation or suspension.

(d)  Has full voting privileges on matters presented before the Club.

(e) May participate in all sanctioned SHMCNY functions, as well as utilize club facilities.

(f)  Possess a valid State Driver’s license with motorcycle endorsement.

(g)  Possess and maintain valid vehicle current registration and insurance

(h)  Has to a fully patched member for a minimum of one hundred and eighty (180) days (6 months)

(i)  Must meet riding requirements per season of 6 or more runs

(j)  Attend meetings as defined in Article 9, Section 4

(k)  Attend events as defined in Article 10, Section 2

(l)  Attend 2 out of state events

 

2) Prospective Member (Prospect): A Prospect is a temporary candidate for regular membership.

A Prospect shall have the right to attend and be heard at all SHMCNY general monthly membership meetings. The Prospect has obligations and privileges of membership, except in voting on matters of club business to include, but not limited to, membership matters and amendments to the by-laws. The prospect period shall not be less than six (6) months or exceed one (1) year. Any extensions must be reviewed by the E-Board. During this time, the Prospect will be presented with Prospect regalia and will wear it to all events attended by members of SHMCNY.

 

Among other requirements sanctioned by the Executive Board, Day one is the day Members of SHMCNY vote to accept an individual as a Prospect, with the individual having properly completed and submitted an application for membership.

(a)    Must complete eight (8) Steel Horses’ runs of 15 miles or more with any SHMC Board member to demonstrate their ability to ride safely.

(b)   Must have a full understanding of the rules of the road, formation and demonstrate the ability to ride in a group as verified by the Road Captains.

(c)    Must have full understanding of the rules, regulations and By-Laws of SHMCNY. 

(d)   Must be able to commit to the initial time required to effectively complete the Prospect phase.

(e)    Must have attempted to create a positive club relationship with all existing SHMCNY members and other SHMC Chapters.

(f)     Must be presented by a member in good standing or a designee for full membership at a general monthly meeting and regular member will also be responsible for candidate through prospecting period.

(g)    Receive an affirmative vote from one-half (1/2) all eligible members present at the general monthly meeting.

 

3) Retired Member:  Requirements for Retired Members: 

(a)  Retired member must have been in fair & standing for 15 years

(b)  Standing to be determined Mother Chapter President, and if Member can wear SHMC vest

(c)  Must pay have ½ amount of monthly dues

(d)  Must attend 4 meetings per year

(e)  Must attend all mandatory meetings

(f)  Must remove bottom rocker

(g)  Must wear Retired Member patch

(h)  Can not hold board position

(i)  Have no voting rights

3a.    Retired Member/No Vest:

If a retired member chooses not to wear a vest:

(a)  Retired member must have been in fair & standing for 15 years

(b)  Pay no due

(c)  Not required to attend mandatory events

(d)  Can not wear club colors (vests) at anytime

(e)  Permitted to wear soft colors only

(f)  Have no voting rights

(g)  Can not hold a board position

 

Section 9. Leave of Absence (LOA): A member in good standing may, for personal reasons, submit a written request to the E-board for a LOA from the club for a time of no less than six months and not to exceed one year, at least thirty (30) days in advance of the leave. If approved, the member on a LOA has no voting rights on club matters and is not counted in quorum votes. The dues amount for a member on a LOA shall be determined by the E-Board upon return of the member to full membership status.  Members on a LOA may participate in club sponsored activities at the same cost as a full-time Regular Member of their chapter with approval of the President.  If the member is an officer other than the President, his/her duties shall be assumed by another member appointed by the President. If the President requests a leave of absence then the Vice President shall assume his/her duties. The LOA may be terminated early at the member’s volition or by the E-board for acts of misconduct or violation of the By-laws.

 

Section 10. Inactive Member: A member seeking Inactive Membership must submit a written request to the E- Board (30) days in advance of intended status change date. An Inactive Membership term is exactly one (1) year or more as predetermined. If approved, the inactive member has no voting rights on club matters and is not counted in quorum votes. Inactive Members will NOT  be required to pay dues, however WILL  be obligated to pay full price to participate in all Steel Horses MC sponsored activities. Colors must  also be relinquished unless a unanimous vote is rendered otherwise by the E- Board. Inactive Membership extensions may be requested, but must first be approved by the E-board. To reactivate full- time Regular Membership, a probationary period will not  be required. If the member is an officer other than the President, his/her duties shall be assumed by another member appointed by the President. If the President requests inactive membership, then the Vice President shall assume his/her duties. The Inactive Membership may be terminated early by the E-board for acts of misconduct or violation of the By-laws.

 

Section 11. AWOL:  Any member absent from monthly meetings or mandatory events without prior written notice given will be considered AWOL.  For the calendar year, any member with three (3) AWOL’s will be suspended.  Any member with six (6) AWOL’s will be terminated from the club. Disciplinary actions for AWOLs are non-vote able.
